These Website Terms govern your access to and use of finovant.ai and any public materials made available through the site. Separate agreements govern Finovant customer workspaces, professional services and enterprise implementations.
1. Acceptance of these terms
By accessing or using this website, you agree to these Website Terms and our Privacy Notice. If you do not agree, do not use the website. If you use the website on behalf of an organization, you represent that you are authorized to do so.
2. Website purpose
This website provides general information about Finovant, its intended platform capabilities, delivery model and potential enterprise use cases. Descriptions, illustrations, sample metrics, screenshots and examples are provided for informational purposes and may not represent a generally available feature, a specific customer configuration or a guaranteed result.
Finovant may change, suspend or discontinue any public website content at any time without notice.
3. No financial, accounting, legal or risk advice
Website content is not financial, accounting, tax, investment, legal, compliance, cybersecurity or risk advice. You should obtain advice from qualified professionals before making decisions in those areas. Use of the website does not create a fiduciary, advisory, professional or customer relationship.
4. Client workspace access
Finovant does not provide public self-service registration. Access to a customer workspace is available only to users invited by an authorized customer administrator and is governed by the applicable customer agreement, SOW, acceptable-use requirements and workspace policies.
You are responsible for maintaining the confidentiality of your credentials and for activity performed through your account. Notify your organization and Finovant promptly if you suspect unauthorized access. Finovant may suspend access where reasonably necessary to protect the service, comply with law or enforce applicable agreements.
5. Acceptable use
You may not:
- Attempt to gain unauthorized access to the website, customer workspaces, systems or networks.
- Interfere with availability, security or normal operation, including through malicious code, automated attacks or unreasonable traffic.
- Probe, scan or test vulnerabilities without written authorization.
- Use automated means to scrape, harvest or extract website content except as permitted by law and applicable technical controls.
- Impersonate another person, misrepresent affiliation or submit false, unlawful, infringing or harmful material.
- Use the website in violation of applicable law or the rights of others.
6. Website content and intellectual property
The website, including its design, text, graphics, interfaces, software, trademarks, logos and other content, is owned by or licensed to Finovant and is protected by intellectual property laws. Subject to these terms, Finovant grants you a limited, revocable, non-exclusive, non-transferable right to access and use the website for legitimate business evaluation.
You may not reproduce, distribute, modify, create derivative works from, publicly display, sell, license or commercially exploit website content without prior written permission, except where permitted by law. “Finovant” and the Finovant logo are trademarks or brand assets of Finovant. No license to use them is granted by these terms.
7. Information and feedback you submit
You represent that information you submit is accurate to the best of your knowledge and that you have the right to provide it. Do not submit confidential customer data, regulated data or sensitive personal information through the public contact form unless Finovant has expressly authorized that method.
If you voluntarily provide feedback about the website or proposed services, Finovant may use that feedback without restriction or obligation, provided it does not identify you or disclose your confidential information in violation of an applicable agreement.
8. Third-party links and services
The website may reference or link to third-party websites and services. Finovant does not control and is not responsible for their content, availability, security or privacy practices. Links do not imply endorsement. Your use of third-party services is subject to their own terms and policies.
9. Enterprise engagements and statements of work
Any customer relationship, implementation commitment, platform access, pricing, service level, security requirement, data processing term, acceptance criterion or support obligation is governed only by an executed agreement and applicable SOW or order form.
If these Website Terms conflict with an executed customer agreement regarding the contracted service, the customer agreement controls for that service. Nothing on the website amends an executed agreement.
10. Disclaimers
To the maximum extent permitted by law, the public website and its content are provided “as is” and “as available.” Finovant disclaims warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness and uninterrupted or error-free operation.
Forecasts, anomaly indicators, recommendations, illustrative outcomes and sample metrics are inherently uncertain and are not guarantees of future performance. Actual results depend on data quality, customer decisions, implementation, market conditions and other factors outside Finovant’s control.
11. Limitation of liability
To the maximum extent permitted by law, Finovant will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, data, goodwill or business opportunity arising from use of the public website.
Where liability cannot be excluded, Finovant’s aggregate liability arising from the public website will be limited to the greater of the amount you paid specifically for use of the public website during the twelve months before the claim or one hundred U.S. dollars. These limitations do not apply where prohibited by law.
12. Indemnity
To the extent permitted by law, you agree to indemnify and hold Finovant harmless from claims, losses and expenses arising from your unlawful use of the website, your violation of these terms or your infringement of another person’s rights.
13. Applicable law and disputes
The governing law and dispute forum for an enterprise customer relationship are stated in the applicable agreement. For use of the public website where no agreement applies, governing law and forum will be determined according to the Finovant entity operating the website and mandatory law applicable to you.
Nothing in these terms limits rights that cannot lawfully be limited, including mandatory consumer or privacy rights where applicable.
14. Changes and severability
We may update these Website Terms by posting a revised version and updating the “Last updated” date. Continued use after the effective date constitutes acceptance of the updated terms. If a provision is found unenforceable, the remaining provisions remain in effect.
